We are Red Flag Registrations Ltd, a company registered in England & Wales. (Company Number: 10068848).

What to expect from this Privacy Notice

Our Privacy Notice explains to you when and how we collect your data and what we use this data for. It also explains the lawful basis under which we process your data, and how this is held.  We explain your rights under the General Data Protection Regulation and provide you with any relevant contact details you may need.


What types of Personal Information do we collect

During our communications with you, over the telephone, face-to-face, in written communications, or via email, we may collect from you and keep a record of the following data in order to process your requests for our services.

Personal Data: first name(s); surname; title; home address; email address, contact telephone numbers; occupation.

Financial Data: bank details;

Transactional Data: details of payments to and from your account with ourselves; invoices; statements; and associated payments.

Please advise us at any time if your information changes or is inaccurate, so that we can update our records and systems.

How do we Use your Information;

There are six lawful bases for processing your data.  We have outlined below which of these lawful bases will apply to how we will process your data:

1. Contract

- To complete the request for services that you require from us pre-contract. Our services include vessel registration services; change of vessel ownership services; UK representation for vessel registration; Tonnage Measurement Surveys and Coding Services.

- To fulfil our contractual obligations to you in respect of the services detailed above;

2. Legitimate Interests

- For the necessary legitimate interests in relation to the provenance of the vessel, including the historical vessel chain of title documentation, and registration certification.

- For the sharing of Personal Data, as detailed on vessel title paperwork and legal documentation, with future owners, the Registry of Ships, Lawyers, Surveyors, Yacht Brokers, and Suppliers.

3. Consent

We will only use Consent as a lawful basis to process your data where there is a specific requirement for us to do so – for instance, for the purposes of marketing. In this instance, we will provide you with clear, unambiguous and specific consent wording to enable you to make an informed decision before you provide your consent to positively opt-in to the said marketing activity.  You will also be provided with an equivalent means of opting out of this consent should you wish to do so.  Any consent must be given freely, and, can be withdrawn at any time by contacting the Data Protection Officer at Red Flag Registrations Ltd, 52 Marine Parade East, Lee on the Solent, Hants PO13 9BW.


4. Legal Obligation

Where we are required to keep and maintain records, including invoice documentation, for a minimum period of 7 years for the purposes of audit and review by HMRC. We have a legal obligation to hold your data on file for this period and will not be able to remove your data from our records during this time.


Who do we share your information with;

To complete our data processing in line with the lawful bases detailed above, and your request for our services, we may also share your data with:

The Maritime & Coastguard Agency (MCA); or Registry of Ships; based in the UK, EEA, and outside of the EEA, acting as processors or joint controllers for the purposes of vessel registration and change of ownership.

Professional Industry bodies and Classification Societies including but not limited to; Royal Yachting Association (RYA); Yacht Brokers Designers Surveyors Association (YBDSA); Ofcom; based in the UK, EEA and outside of the EEA, acting as processors or joint controllers for the purposes of arranging tonnage measurement surveys and radio communications.

Tonnage Measurers and Surveyors; based in the UK, EEA, and outside of the EEA, acting as processors or joint controllers for the purposes of completing tonnage measurement and coding surveys.

Lawyers; Yacht Brokers; and Suppliers based in the UK, EEA, and outside of the EEA, acting as processors or joint controllers for the purposes of providing vessel registration services.

Regulatory bodies: HM Revenue & Customs based in the UK

Future vessel owners; based in the UK, EEA, and outside of the EEA, acting as joint controllers, for transactional purposes.

IT Service Providers: We may share your data with Microsoft through our use of Microsoft Office 365.  Office 365 is a GDPR compliant I.T. system and service that we use to keep your data safe and secure.

International Transfers:

To fulfil our obligations to you for our services it may be necessary for us at times, to transfer your Personal Data outside the UK and EEA during the course of business. This is acceptable where the organisation and third countries receiving and processing your data have adequate safeguards in place, and the protections afforded by those countries do not undermine the protection afforded by the GDPR standards.

This applies where you have requested us to do so; or, where it is necessary to do so to fulfil our contractual and legal obligations; or where it is necessary to do so under our legitimate interests where there is no detrimental impact to your fundamental rights and freedoms.

How long do we keep your Information;

We will hold your personal information on our records and systems for as long as is necessary and in accordance with our lawful basis for processing data under Contract, Legal Obligation, Legitimate Interests, and where applicable, Consent.  

Where consent applies as a lawful basis for processing your data, and you withdraw your consent for us to hold that data, your personal information will be deleted from our records and systems for that purpose within one calendar month of the receipt of this request. Please be advised that without your consent we may be unable to provide the products and services that you have requested.

Your Right to Restrict, Object to & Withdraw consent

You are entitled to object, restrict and withdraw your consent for us to hold your data, at any time. Your Right to Access your Personal Information

You have the right to request sight of the Personal Data and information that we hold about you. This is a called a Subject Access Request.
